Supreme Court reserves judgment in Bauchi gov election
The Supreme Court has reserved judgment in the appeal by the All Progressives Congress Bauchi governorship candidate, Sadique Abubakar against the election of Governor Bala Mohammed.
Both the tribunal and court of appeal had dismissed Abubakar’s appeals for lack of merit.
Abubakar contended that several electoral documents used during the poll were not properly filled.
However, the appellate court held that the APC candidate failed to provide credible evidence and testimony to buttress his allegations.
Abubakar who was displeased with the appeal court’s verdict appealed at the Supreme Court.
At the proceedings on Thursday, Abubakar’s lawyer, J. Owonikoko, while urging the court to reverse the order of the lower court, argued that the court failed to make pronouncement on the invalid electoral documents tendered as evidence.
INEC counsel, Mohammed N., told the apex court that the tribunal only found blank spaces in some of the electoral forms and not on all the forms.
Mohammed said there was no evidence of forms that were improperly filled at the tribunal.
Counsel for the governor, Chris Uche, however, described the appeal as needless.
Uche said the appellant did not produce any witness to back the documents presented.
He said, “The appellants never brought any witnesses to speak to the electoral documents tendered at the tribunal.
“They did not have materials to support their case. I urge my lords to dismiss this appeal. ”
After listening to the parties’ argument, the five-man panel of the court led by John Okoro reserved judgment on the matter.
